Brazil issues data protection bill

On 28 January 2015, the Brazilian government issued a Draft Bill for the Protection of Personal Data (Anteprojeto de Lei para a Proteção de Dados Pessoais).

The Draft establishes a comprehensive, European-style data protection framework for the processing of all personal data. It applies to individuals and companies that process personal data via automated means, provided that the (1) processing occurs in Brazil or (2) personal data was collected in Brazil. The bill gives rights to access, correct, and delete personal data; requires informed consent prior to treatment; and imposes obligations to report data breaches.
