Cal Bus & Prof Code § 22580 (protection of minors’ online identity) to enter into force on January 1, 2015

Senate Bill n. 568 added chapter 22.1 (commencing with Section 22580) to Division 8 of California Business and Professions Code. The law will go into effect on January 1, 2015.

The law requires the operator of a website, online service or application directed to minors under 18 – or an operator that has actual knowledge that a minor is using its service or application – to (i) make its privacy policy available to users, providing notice of what information is being collected and how it is being used; (ii) permit the minor to remove or, at the operator’s discretion, request and obtain removal, of content or information posted on the service or application by the user; and (iii) inform the minor of the possibility to remove or request removal of the content or information.

The law also prohibits the operator from marketing or advertising specified types of products or services to minors or to disclose to third parties the minor’s personal information.
