Judge orders wife to remove wedding pictures from Facebook because husband did not consent

An Italian wife published pictures of honeymoon on her Facebook profile and husband sued to have them removed.

Judge sided with the husband and granted an injunction ordering the wife to remove the pictures.

Pursuant to Article 10 of the Italian Civil Code and to Article 10 of a 1941 law (Law 633/1941), the pictures were published without the portrayed person’s consent (which is required save exceptions).

The judge rejected the wife’s theory that that law should be interpreted as to take into account the evolution of technology.
