Federal Communications Commission to pre-empt state laws preventing broadband services expansion

 

On February 26, 2015, the Federal Communications Commission (FCC) voted in favor of the petition filed by two municipal broadband providers asking for preemption of North Carolina and Tennessee’s state laws restricting the abilities of communities to provide broadband services. Following Congress’ instructions, the FCC’s decision enabled two broadband service providers to seek customers outside of their current boundaries.

The FCC assumed authority under Section 706 of the Communications Act of 1996 to regulate communications in the public interest.
