Illinois allows for reimbursement of unearned fees in case of lawyer’s death or disability

The Illinois Supreme Court amended Rule 780 in order to expand the protection of Illinois lawyers’ clients. Starting on Feb 9, 2015, a client whose case is not completed due to the death or disability of the attorney, and who has made reasonable efforts to pursue civil remedies, is eligible to apply for reimbursement of unearned fees paid to the attorney.

The client may seek reimbursements by filing a claim under the Client Protection Program (CPP), administered by the Illinois Attorney and Registration Commission (ARDC).
